The bill of lading is non-negotiable and the sender acknowledges that it was prepared by the sender or by Gemex on behalf of the sender. The consignor ensures that the owner of the goods transported in accordance with this document remains or is the authorized agent of any other person having an interest in the consignment (consignment).

Consignor’s obligations and declarations/approves and guarantees the consignor

Each material in the dispatch is described in detail and correctly in the bill of lading
The consignment shall not contain material deemed non-transferable
The consignment data (shipment) is clearly and correctly stated and the consignment is packaged and sent securely to ensure safe transportation with regular care and handling.

The consignor understands and agrees that GEMEX Logistics may waive and/or renounce any consignment or any part thereof transmitted by the consignor when GEMEX Logistics identifies and declares that it is unacceptable or that the consignor has reduced the value for customs purposes or mischaracterized either internationally or not no liability whatsoever and that the consignor maintains, defends and keeps Gemex Logistics immune from any claims or damages arising therefrom.

The consignor shall be liable individually for all costs and expenses, including but not limited to income tax, customs duties or any other taxes or charges relating to the consignment (consignment) and for any costs or expenses incurred in connection with the return of the consignment to the consignor, including the deposit, storage or disposal thereof in any manner whatsoever.

The consignor understands and agrees that Gemex Logistics reserves its right at its discretion to send the shipment through its agents or through a third party contracting with Gemex Logistics to perform the required service.

Right to inspect and inspect the consignment: Gemex Logistics reserves the right to inspect or inspect any consignment, but is not obliged to do so. In doing so, it is authorized to open the dispatch and inspect any purpose/substance within it. In that case, Gemex Logistics will exercise reasonable care but will not be liable for any damage to the consignment and not for any delay as a result of that inspection.

Seizure of movable goods: Gemex Logistics reserves the right to seize all movable goods for all freight charges in accordance with this document and may refuse to deliver the consignment until such time as such charges are paid.

Limits of liability for direct loss:

Direct loss means the permanent destruction or disappearance of the consignment (consignment) or any part thereof when it is under the bail/custody of GEMEX Logistics or its agents and includes the consignment of goods delivered to GEMEX Logistics and set out under the freight policy.

Gemex Logistics is not liable for the subsequent loss which means any loss or damage other than the direct loss incurred or alleged to have been incurred by the consignor or by any other person as a result of the transfer of the consignment through Gemex Logistics or its employees, agents, or as a result of the breach of Gemex Logistics, employees or agents of the consignment transfer agreement

Exclusion of Liability for Delay: Gemex Logistics does not assume liability for delay. This means any delay in receipt, transfer or delivery of any dispatch, misdelivery or non-delivery of any dispatch due to:

Conduct or negligence of Gemex Logistics employees or agents
Incident in Qader and Qader
Force majeure, which includes but is not limited to industrial tendencies or politics, kidnapping, war or threat of war, the actions of foreign governments and any other reason beyond the control of Gemex Logistics.
Conduct, infringement or negligence of the consignee, consignee or any other party claiming a personal interest in the consignment, including any breach of any such requirement; Or anyone Gemex Logistics or any customs or government employee. with any postal services, shipping agent or other person to whom the consignment is provided by Gemex Logistics to be transferred to any place where Gemex Logistics’ services do not reach, regardless of whether it is at the request of the consignor or whether it is aware of the arrangements for the delivery of third parties.
The nature of the mission itself or any defect, characteristic or defective

Claims: Gemex Logistics must be notified in writing of any claim within 15 years 15 days from the date of delivery contained in the Agreement and Gemex Logistics reserves its right to refuse to accept any unreported claims In any event, Gemex Logistics is not liable to accept any claim unless the consignor has paid all fees due to Gemex Logistics under this Agreement and the consignor may not set off any amount of its claim against such fees.

Prohibited substances: Except for the express written consent of the employee approved by Gemex Logistics, the following substances are prohibited for transfer (coin, stamps, artwork, jewelry, precious metals, gemstones, Gold or silver alloys, firearms and explosives, bank checks, payment orders, Travellers’ checks, antiques, plants, animals, drugs, foodstuffs, Liquid materials, tobacco, perishable goods, tradable commercial papers in the form of bearer’s bond, Lascivious or pornographic pornography, industrial funds and diamonds, prohibited materials by the International Transport Union including hazardous and flammable materials prohibited by any official or local federal government of any State or region from or through the consignment to be transported prohibited substances “, any other substances reported from time to time by Gemex Logistics as prohibited substances)

Insurance: The consignment insurance shall be the responsibility of the consignor and shall notify Gemex Logistics in writing of its desire to insure the shipment against the risk of shipment prior to the delivery of the consignment to Gemex Logistics and of the nature and value of the goods and the extent of the coverage required.

Contract Law: The consignor and Gemex Logistics Company agree irrevocably to apply the laws of the Republic of Turkey to each article and exclusively to the exclusive jurisdiction within the Republic of Turkey.
